On this one thing alone, it should shout out that she doesn’t belong in the position she is in. But then again, neither does Obama or any of the others in our government who do not believe in the Constitution or the founding Documents.
The other day the confirmation hearing for Elena Kagan began, the opening statement started out the meeting. The statement was by Senator Sessions when he said this:
The nominee was the central figure in the Clinton-Gore effort to restrict gun rights, and as a dramatic 5-4 decision today in the McDonald case shows the personal right of every American to own a gun hangs by a single vote on the Supreme Court. Miss. Kagan was also the point person for the Clinton administration’s effort to block congressional restrictions on partial-birth abortions. During her time as dean at Harvard, Ms. Kagan reversed Harvard’s existing policy and kicked the military out of the recruiting office in violation of federal law. Her actions punished the military and demeaned our soldiers as they were courageously fighting for our country in two wars overseas.
Miss. Kagan told the court that the speech and press guarantees in the First Amendment would allow the federal government to ban the publication of pamphlets discussing political issues before an election. I would remind my colleagues that the American Revolution was, in no small part, spurred by just such political pamphlets. Thomas Paine’s Common Sense. To suggest that the government now has the power to suppress that kind of speech is breathtaking.
In the wake of one of the largest expansions of government power in history, many Americans are worried about Washington’s disregard for limits on its power. Americans know that our exceptional Constitution was written to ensure that our federal government is one of limited, separated powers, and part of a federal state system with individual rights reserved to our free people. But we’ve watched as the president and Congress have purchased ownership shares in banks, nationalized car companies, seized control of the student loan industry, taken over large sectors of our nation’s health care system, and burdened generations of Americans with crippling debt.
This was but the beginning. But, I am afraid, that this woman is going to be confirmed, even though she is no where near being qualified to be a Supreme Court Judge. But like I said, that was but the beginning. Yesterday, it was Republican Tom Coburn of Oklahoma going at her. He was asking about natural rights. According to the Declaration of Independence. And she was not sure. She was not sure of the Declaration of Independence. And she wants to be a Supreme Court Judge???? Here is Tom Coburn:
“Do you agree that the natural right of resistance and self-preservation — the right of having and using arms for self-preservation and defense. He didn’t say that was a constitutional right. He said it’s a natural right. I’m asking with you: Do you agree with that?”
KAGAN: Senator Coburn, t-t-to be honest with you, I — I — I don’t have a view of what are natural rights, independent of the Constitution. And my job as a justice will be to enforce and defend the Constitution and other laws of the United States.
COBURN: So you wouldn’t embrace what the Declaration of Independence says, that we have certain God-given, inalienable rights that aren’t given in the Constitution? That they’re ours and ours alone and that government doesn’t give those to us?
KAGAN: Senator Coburn, I believe that the Constitution is an extraordinary document, and I’m not saying I do not believe that there are rights pre-existing the Constitution and the laws, but my job as a justice is to enforce the Constitution and the laws.
To Kagan, it is to hell with the Declaration of Independence. There is nothing important about it. It only is one of the founding documents, and it isn’t important to her. Just like it isn’t important to any of the Liberals out there. She is essentially just throwing the whole concept of natural law down the proverbial toilet while flushing it. It is something that should tell us all that she doesn’t care about the declaration of Independence. You remember where it says: “We are all endowed by Our Creator with certain inalienable rights, among them, life, liberty, and the pursuit of happiness.” Tom Coburn asked her essentially if she believed that, and her answer was that she wasn’t sure. She wouldn’t even commit to the idea that human beings possess certain inalienable rights that existed before the United States Constitution. And you mean to tell me that she is the best person that Obama could find to become the next new justice of the United States Supreme Court?
And Tom Coburn was beside himself that she would not even comment on the concept of natural rights, natural law, and inalienable rights. So he continued:
COBURN: Well, I understand that. Well, I’m not talking about as a justice. I’m talking about Elena Kagan. What do you believe? Are there inalienable rights for us? Do you believe that?
KAGAN: Senator Coburn, I — I think that the question of what I believe as to what people’s rights are outside the Constitution or the laws, that you should not want me to act in any way on the basis of such a belief if I had one or —
COBURN: I would want you to always act on the basis of a belief of what our Declaration of Independence says.
KAGAN: I — I think you should want me to act on the basis of law, and, uh — and that is what I have upheld to do if I’m fortunate enough to be confirmed is to act on the basis of law, which is the Constitutions and the statutes of the United States.
I swear, the liberals are winning here. Even though the Conservative movement is up in arms right now, and will probably win big this November, here is what is going to happen. When we win in November, we will go back to living our lives. We have them you know. But the liberals will analyze what they did wrong this time, and work on the next time….because it will come. And each time they get they’re chance, they win more and more. If you don’t believe me, look back over the century and see how many things that used to get us up in arms, now no longer do. Things that Americans used to say would never be passed into law, have been. And it is all due to the persistence of the Liberal left to continue fighting for what they want….while the Conservatives go back to living their lives and enjoying being American. The Liberal left never does. They go back to working on destroying the liberties that we as Americans enjoy.
Obama, Kagan, Pelosi, Reed, and the rest are but the latest incarnation of what the left is doing to this country. We have got to stop it. or our children won’t have an America to enjoy.
And on a final note, today is my dad’s birthday. He died in 1998, but if he had lived, today he would have been celebrating his 84th birthday. So, happy birthday dad. I miss you.
